North Dakota and the R&D Tax Credit
The Income Tax Credit for Research and Experimental Expenditures is a permanent tax credit available to corporations and flow-through entities. The credit rate is 25% for the first $100,000 of excess expenses and 8% for excess expenses above $100,000. Any unused credits can be carried forward up to fifteen years and carried back three years. Additionally, eligible primary sector businesses conducting qualified research in North Dakota for the first time after 2006, with annual gross revenues under $750,000, can sell or transfer up to $100,000 of unused tax credits upon certification by the Department of Commerce Division of Economic Development.
